Florida’s general limitations period for breach of fiduciary duty is four years from discovery of the breach under Florida Statutes Section 95.11(3). A trust contest carries its own deadline under Section 736.0604, which can be as short as six months after the trustee sends a copy of the trust instrument and proper notice of the trust’s existence. In some situations, a trustee’s formal notice triggers a separate six-month clock that runs independently.

Standing matters too. Not everyone connected to a trust can challenge it. Florida law limits who may bring a trust contest to those with a direct legal interest, including named beneficiaries, beneficiaries of a prior trust, and in some circumstances, the grantor.
